These Terms of Service ("Terms") govern your access to and use of the Clip Foundry service ("Service") operated by Clip Foundry sp. z o.o. ("we", "us"). By creating an account or using the API, you accept these Terms.
1. Service description
Clip Foundry is an AI-powered video generation pipeline. You submit a prompt; we orchestrate scene-splitting, text-to-speech, image generation, and video rendering and return a finished short video. Outputs are generated by third-party AI models and may contain inaccuracies. You are responsible for reviewing outputs before public use.
2. Account & eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction. You authenticate via Google; we do not store passwords. You are responsible for keeping your API keys confidential.
3. Tokens & billing
The Service uses a prepaid token model. Tokens are purchased via Stripe and do not expire. Each rendering job deducts tokens based on the scenes, voices, and image-generation calls used; the quote is shown before the job starts. Tokens are not currency; they have no cash value and cannot be transferred between accounts.
Unused tokens may be refunded within 14 days of purchase under EU consumer law (Article 16 of Directive 2011/83/EU). Tokens already spent on completed renders are non-refundable because the digital content has been delivered.
4. Content & ownership
You retain rights to the prompts you submit. Subject to your payment of tokens, we assign to you all rights we have in the generated outputs. You are solely responsible for your prompts and for the outputs you publish. Generated content may inadvertently resemble copyrighted works; you must review before publication.
5. Acceptable use
You may not use the Service to generate:
- Sexual content involving minors;
- Content depicting real individuals without their consent;
- Defamatory, harassing, or hateful content;
- Content that violates intellectual property rights;
- Content that misrepresents itself as a real person or event for the purpose of deception (deepfake disinformation).
We may suspend or terminate accounts that violate these rules, with refund of unused tokens at our discretion.
6. Availability & limits
The Service is provided "as is" without warranties of availability, fitness for a particular purpose, or non-infringement. Rate limits apply per API key. We may modify or discontinue features with 30 days' notice for paid users.
7. Liability
To the maximum extent permitted by law, our aggregate liability for any claim arising from the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
8. Governing law
These Terms are governed by Polish law. Disputes are subject to the exclusive jurisdiction of the courts of Warsaw, Poland, except where EU consumer law grants you the right to sue in your home jurisdiction.
9. Changes
We may update these Terms. Material changes will be notified by email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
